First judicial reform initiative presented for the State of Estado de México >>>
#EstadoDeMéxico.- The Morena party in the LXII Legislature of the State of Mexico presented this November 19 a constitutional reform initiative to harmonize local legislation with the federal Constitution in judicial matters and incorporate, among other things, the election of local magistrates and judges by popular vote.
The proposal presented to the plenary by Deputy Octavio Martínez Vargas, aims that on June 1, 2025, half of the 56 magistrates, as well as the 438 local judges and judges and other vacant judicial positions will be renewed at the ballot box so that the rest will be renewed in 2027.
Remuneration and duration
Among the 23 amendments to various articles of the local Constitution, four additions and three repeals of articles of the state Constitution, it is also important to mention that no judicial servant may earn more than the President of the Republic.
It also contemplates that the term of office of magistrates will be reduced from 15 to nine years, but that the term of office of judges and judges of first instance will be increased from six to nine years.
As well as the term of judges and judges of lower courts, who currently serve for three years, it is now proposed to serve for a period of nine years.
Requirements
In addition to the number of positions to be renewed, the proposal includes changes to the requirements for judges and magistrates, such as reducing the required age from 35 to 30 years old, in addition to having a law degree with a minimum grade point average of 8.0 and a 9.0 in subjects related to the position to which they are applying.
In order to aspire to positions as judges and magistrates in Mexico, it is proposed that a professional practice of at least five years in the practice of law be required, as well as 10 years of seniority in the case of plenary magistrates, five years for magistrates and three years for judges.
