México receives request from the USA for the establishment of a Rapid Response Labor Panel / @SE_mx >>>

#Economía.- The Office of the United States Trade Representative (USTR) formally requested the Ministry of Economy to establish a Rapid Response Labor Panel to settle the differences between governments regarding the labor dispute at the San Martin Mine, located in Sombrerete, Zacatecas.

This is after the Mexican Government determined on August 1 that the Mina San Martin case is outside the scope of the Rapid Response Labor Mechanism. Read the communiqué here.

A first reason why Mexico rejected the U.S. request for review is elementary: to enforce the legal principle of non-retroactivity of the Treaty between Mexico, the United States and Canada. In other words, the T-MEC would not be applicable to the facts related to this dispute.

Second, in any event, this labor dispute has been analyzed by the competent national courts, which is why interference from a parallel proceeding under the T-MEC would not be acceptable.

This is the first time that a Rapid Response Labor Mechanism leads to a panel, so it will be essential to ensure that the principles of impartiality and certainty prevail at every stage.

The Ministry of Economy is in charge of representing the Mexican State before this panel, in coordination with the Ministry of Labor and Social Welfare, as well as other competent labor authorities. Mexico will assert its position before the panel in accordance with the deadlines established in the Agreement.
