SICT strengthens powers of the Rail Transport Regulatory Agency / @SICT_mx >>>

#SICT.- With the purpose of “proposing and, if necessary, executing policies and programs for the development, promotion, supervision and logistics of the passenger and multimodal mass transit railway system”, the Ministry of Infrastructure, Communications and Transport (SICT) strengthens the powers of the deconcentrated body Railway Transport Regulatory Agency (ARTF, for its acronym in Spanish).

The Agreement, which will become effective as of tomorrow, was published this Tuesday in the Official Gazette of the Federation (DOF).

The strengthening of the ARTF is framed in that “the current administration aims to develop national rail infrastructure to enhance passenger and cargo transportation through the integration of a network with an intermodal approach that provides an economic, safe, sustainable and efficient service”.

It emphasizes that the ARTF in coordination with the SICT and the Ministry of Finance and Public Credit, through the Administration and Finance Units, will carry out the necessary administrative acts to transfer to said Agency the resources assigned to them in the Federal Expenditure Budget for Fiscal Year 2025, within a term not to exceed 20 working days following the entry into force of this Decree.

Likewise, the human, financial and material resources currently available to the General Directorate of Railroad and Multimodal Development will become part of the ARTF.

Among the powers that the Agency will have are:

• Propose and, as the case may be, execute the policies and programs for the development, promotion, supervision and logistics of the railroad system, mass passenger and multimodal transportation.
• Plan the strategic development in railroad matters and process petitions related to the granting of concessions and assignments for the construction, operation and exploitation of general railroad communication routes and for the rendering of public railroad transportation services, as well as their extension, modification, nullity, assignment, termination and revocation, in terms of the applicable legal provisions.
• To carry out the public bidding procedures for concessions for the construction, operation and exploitation of railroads, as well as those corresponding to concessions for the rendering of the public railroad transportation service.
• To carry out the procedures for the contracting of railroad public works and related services, including those related to the construction of railroad tracks, yards and terminals of federal character for the establishment and operation of mass passenger and multimodal transportation railroads, in accordance with the applicable legal provisions.
• To plan and coordinate with the competent administrative authorities of the three levels of government and with concessionaires or individuals, the construction, reconstruction or modernization and expansion of sections of federal railroads, as well as the construction of bypasses that avoid passing through towns.
