Mexico and United States successfully close the case at Goodyear-SLP Mexico >>>

#Economy.- The Government of Mexico, through the Ministry of Labor and Social Welfare (STPS) and the Ministry of Economy (SE), reports the successful closure of the case regarding the alleged denial of freedom of association and collective bargaining rights at the Goodyear Mexico plant located in San Luis Potosí, San Luis Potosí. The above, in the framework of the Labor Rapid Response Mechanism in Specific Facilities (MLRR) of the Treaty between Mexico, the United States and Canada (T-MEC).

In the results of the investigation that Mexico shared with the United States on July 6, 2023, the existence of certain actions by the company that could have constituted a denial of such rights was determined.

On July 18, 2023, both governments agreed to a Remediation Plan, which has been fully complied with to date. The following actions taken by the company in this Plan are noteworthy:

  • Published and disseminated a letter of commitment to neutrality in union matters and a document defining guidelines for conduct by company personnel;
  • Trained all personnel on the neutrality charter, the guidelines for conduct, as well as the rights to collective bargaining, freedom of association and the Contract Law;
  • Facilitated the STPS to provide 19 training sessions to all workers at the plant on freedom of association and collective bargaining rights;
  • The company provided a list of active workers at the facility for the last 12 months;
  • The company was able to negotiate, agree and sign five unique agreements with the union for the correct and full application of the Contract Law;
  • Committed to continue to apply any and all wages and benefits provided for in the Collective Bargaining Agreement negotiated in 2022 or currently provided to covered workers that are in excess of the terms of the Contract Law until such time as an agreement is reached with the workers through a collective bargaining process;;
  • Fully compensated each worker covered by the contract for any wages or benefits the worker did not receive as a result of the failure to enforce the Contract Law;
  • Regularly and continuously reported to Mexico on the progress of the implementation of the actions of the Remedial Plan;
  • Distributed the most recent copy of the Contract Law (2015) and its comprehensive revision (2017) to all working persons at the plant;
  • Committed to support the right of its workers to determine their certification process and union representation without coercion;
  • Installed and publicized the existence of an anonymous and confidential direct electronic mailbox to file complaints of violations;
  • The company published information on how workers can file complaints with Mexico regarding rights violations, discrimination, threats, retaliation, harassment or violence.
