The International Court of Justice reaffirms the inviolability of diplomatic missions / @aliciabarcena @SRE_mx >>>
#SRE.- On April 11, Mexico filed a lawsuit before the International Court of Justice (ICJ) against Ecuador, following the violent raid by the Ecuadorian police on the Mexican embassy and the aggression against diplomatic personnel on April 5.
Today, the Court reiterated the importance of the principles enshrined in the Vienna Convention, and stressed that “there is no more fundamental prerequisite for the development of relations between States than the inviolability of diplomatic envoys and embassies […] in particular, the institution of diplomacy […] to enable States, whatever their different constitutional and social systems, to reach mutual understanding and to settle their differences by peaceful means”.
Likewise, because Ecuador offered Mexico guarantees, both in writing and during the public hearings, to ensure the respect and protection of our diplomatic premises, their property and archives, in the city of Quito, as requested by our country, the ICJ determined that the guarantees offered, unconditionally and repeatedly, are legally binding.
Therefore, Ecuador is obliged to grant Mexico:
Full protection and security of the facilities, property and archives of the Mexican diplomatic mission in Quito to prevent any form of intrusion.
To allow it to vacate the premises of the diplomatic premises and the private residences of its diplomatic agents.
Refrain from any action that may aggravate or widen the dispute before the Court and, instead, seek the peaceful settlement of disputes.
