México and the United States successfully close Asiaway case under the T-MEC Rapid Response Labor Mechanism / @SE_mx >>>

#SE.- The Government of Mexico, through the Ministry of Labor and Social Welfare (STPS) and the Ministry of Economy (SE), reports the successful closure of the case regarding the alleged denial of freedom of association and collective bargaining rights at the Asiaway Automotive Components Mexico, S. de R.L. de C.V. (Asiaway) plant, located in the state of San Luis Potosi, within the framework of the Labor Rapid Response Mechanism in Specific Facilities (MLRR) of the Treaty between Mexico, the United States and Canada (T-MEC).

The results of the investigation, which Mexico shared with the United States on December 7, 2023, determined the existence of certain actions by the company that could have constituted a denial of such rights.

However, during the period of the Mexican Government’s investigation, Asiaway carried out the following remedial actions, in coordination with the Ministry of Labor and Social Welfare:

  1. A letter of commitment to neutrality in union matters and a document defining guidelines for conduct by Asiaway personnel were published and disseminated;
  2. The company trained all employees of the plant on the content of the neutrality charter and the guidelines for conduct;
  3. The STPS trained all company employees on freedom of association and collective bargaining rights in Mexico;
  4. Asiaway reinstated the worker who had been unjustifiably dismissed.
