Mexico appeals to the International Court of Justice to hold Ecuador accountable for the tort committed against our country / @aliciabarcena @SRE_mx >>>

#SRE.- On instructions from President Andrés Manuel López Obrador and the Secretary of Foreign Affairs, Alicia Bárcena Ibarra, the Foreign Ministry participated before the International Court of Justice (ICJ) in the hearings on the request for provisional measures in the case of the Embassy of Mexico in Quito (Mexico vs. Ecuador).

The Mexican delegation, headed by legal consultant Alejandro Celorio Alcántara, was made up entirely of civil servants. Among them were people from the Mexican Foreign Service with extensive experience in international litigation, including those brought against commercial negligence that facilitates the illicit trafficking of arms into Mexico.

On April 30, the Mexican delegation presented oral arguments, which addressed the following points:

the existence of jurisdiction for the Court to issue the requested measures;
the existence of rights in favor of Mexico, recognized in the Vienna Convention on Diplomatic Relations, specifically the right that diplomatic premises, as well as its property, archives and documents, enjoy inviolability and Ecuador guarantees their security and protection; and
the urgency of issuing the measures, since there is an imminent risk of irreparable damage to Mexico’s rights, since Ecuador (1) generated an atmosphere of distrust in the entire region; (2) has shown a continuous lack of good faith in complying with its international obligations; and (3) has not provided Mexico with sufficient guarantees that it will comply with its international obligations.
For its part, on May 1, Ecuador had the opportunity to present its oral arguments. Ecuador sought to challenge the arguments offered by the Mexican delegation, in particular by pointing out that Mexico had not resorted to negotiation to settle the dispute that arose after the break-in by its security forces. It characterized the break-in as an «exceptional act», recognizing that there is an obligation not to enter an embassy without permission.
