Mexico and the United States successfully close RV Fresh Foods case under T-MEC Rapid Response Labor Mechanism / @SE_mx >>>
#Economy.- The Government of Mexico, through the Ministries of Economy and Labor and Social Welfare (STPS), reports the successful closure of the case regarding the alleged denial of freedom of association and collective bargaining rights at RV Fresh Foods, located in the municipality of Uruapan, Michoacán, as part of the Labor Rapid Response Mechanism in Specific Facilities (MLRR) of the Treaty between Mexico, the United States and Canada (T-MEC).
The results of the investigation that Mexico shared with the United States on April 1 of this year determined the existence of actions by RV Fresh Foods that could constitute violations of Mexican labor law and a denial of rights:
Employer interference in union affairs tending to hinder the free development of the activities of the National Union of Workers and Employees of the Commerce, Food, Textile, Textile, Automotive, Metallurgical, Services and Distribution Industry “Generalísimo José María Morelos y Pavón” of the National Central Confederation (COCENA), through three actions: (a) Restricting COCENA’s access to carry out union activities within the company; (b) Intervening in the process of electing union delegates through the assignment of those who, in the company’s opinion, should hold the position of representatives; and (c) In agreement with COCENA, making a monthly payment to this union, in substitution of union dues.
There is evidence to affirm that COCENA and RV Fresh Foods entered into a protective Collective Bargaining Agreement (CBA).
